The rules of the road for using divinekarmainstitute.com and the Institute's applications.
By accessing or using the Services, you confirm you have read and accepted these Terms, our Privacy Policy, and our Disclaimers. If you do not agree, please do not use the Services.
You must be at least 13 years old to use the Services. If you are under 18 (or the age of majority in your jurisdiction), you may use the Services only with the involvement and consent of a parent or legal guardian. The Services are not directed at children under 13, and we do not knowingly collect personal information from them.
Some features of the Services do not require an account. Where an account is required (for example, optional cross-device sync), you agree to:

Subject to your compliance with these Terms, the Divine Karma Institute grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own non-commercial use.

The Services let you write journal entries, log decisions, set value hierarchies, and otherwise create content. Your content belongs to you. We do not claim ownership of anything you write or log.
By default, your content is stored locally on your device. If you enable optional cross-device sync, your content is encrypted on your device before it leaves, and our servers store only opaque ciphertext. See our Privacy Policy and How We Work for the full architecture.
You grant us a limited license to display your content back to you within the Services, and to operate the Services on your behalf. This license terminates when you delete the content or close your account.
The Services, including all software, designs, text, graphics, logos, and the Divine Karma Institute crest, are owned by David Ramirez or the Divine Karma Institute and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of the Services to you.
The books, essays, and writings published under Divine Karma Publishing (including those available at divine-karma.com) are independently copyrighted works. Limited quotation with attribution is permitted; reproduction or distribution requires written permission.
Copyright complaints: If you believe your copyrighted work has been used on the Services without authorization, please send a notice to hello@divinekarmainstitute.com with the information required under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Some applications are free; some are paid; some offer optional paid features or subscriptions. App purchases made through the Apple App Store or Google Play Store are subject to those stores' terms in addition to these Terms. Refunds for in-app purchases are handled through the relevant app store under that store's policies.
Where the Institute sells digital goods or subscriptions directly (for example, through divinekarmainstitute.com), specific purchase terms, taxes, and refund policies will be presented at the point of purchase.
The Services may link to or interoperate with third parties (such as Apple's App Store, payment processors, or external websites). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms.
The Services are reflective and entertainment tools. They are not medical devices, mental health services, diagnostic tools, financial or legal advice, or substitutes for therapy, counseling, medical care, or licensed professional services. See our Disclaimers for the full statement.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any specific outcome will result from their use.
To the maximum extent permitted by law, the Divine Karma Institute and David Ramirez shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our total cumulative liability for any claim arising from the Services shall not exceed the amount you paid us for the Service in the twelve months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless the Divine Karma Institute, David Ramirez, and any agents or contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.
You may stop using the Services at any time. You can delete your data from the Services in-app at any time, and your data will be permanently removed (see our Privacy Policy).
We may suspend or terminate your access if you violate these Terms, if required by law, or if continued access poses a security or legal risk. Where reasonably possible, we will notify you before doing so. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
These Terms are governed by the laws of [STATE OF GOVERNING LAW], without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of that provision.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Material changes will be communicated in-app or by email where reasonable. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
